She had always paid her rent on time, but when her landlord decided to turn against her whilst heavily pregnant, she found herself homeless due to a pack of lies.
Living Situation
She lived with her daughter in a mobile home, to which she had a land lease and paid monthly rent. She was also expecting a new baby. Having always paid her rent, she was surprised when things took a drastic turn one day. It came quite out of the blue.
An Expectant Mother
Her pregnancy caused a lot of complications due to a few existing medical conditions. As a result, she was informed that her pregnancy would have to be closely monitored, and she was advised to avoid stress where possible.
Single Parenting
She had a daughter from a previous relationship, and her new baby was from a different relationship that hadn’t worked out. She’d already decided to leave him, but when she found out she was pregnant, she knew she wanted to keep the child.
Non-payment of Rent
One day, her landlord informed her that she was behind on payment. She denied this, stating that she had always been an excellent payer. In fact, she often paid early or upfront to avoid any later issues.
Denied her Statement
Her landlord refused to accept this, and as she paid cash, it was impossible to prove. She was angry at herself for agreeing to pay cash in the first place despite her concerns. However, it was a neat situation that had always worked well.
Another Allegation
On top of this, the landlord accused her of having people staying with her. She denied this also, saying that she never had anyone stay beside her daughter. She sensed that there was more at play, and they just wanted her out.
Lease Agreement Breach
They broke her lease before the first of August, which is a new rental period under their own policy, and then refused to accept rent for the month of August. She was currently paid up to July.
Accepting an Offer
Then, in August, instead of accepting rent for August, they gave her a low-ball offer. She agreed solely to remedy the situation before it escalated to such a state that would disturb her children’s stability and peace. So they could just be out of there.
Personal Challenges
Dealing with a very high-risk pregnancy, medical issues, the loss of her father, and the inevitable period of grief, she accepted that she needed to and was keen to just move along peacefully.
Changing Agreements
Unfortunately, by mid-August, when she mentioned she had other buyers interested and nothing was happening on their end, they decided they would try to stop the sale. They stopped giving out applications to potential new tenants to whom the home could have been sold, nor did they go through with their initial offer.
Hospitalization
She ended up in the hospital on and off due to the pregnancy, which they were aware of during this time, and she had to have her daughter’s dad watch over the home. It was looking after the pets and other basic chores while taking her daughter to spend time there before going home with him.
Dispute over Guest Stays
They had an issue with this, but it fell under him still being considered a guest. He did not exceed their thirty days out of the calendar year rule, and he did not stay overnights unless he absolutely needed to.
A Court Issue
Eventually, the landlord advised her that he was taking her to court. She was completely confused about the whole matter and couldn’t understand why he was being so harsh on her.
The Court Case
The landlord flat-out lied to the judge, who granted them in favor. They told the judge SHE was behind on her rent but also filed for ‘unknown occupants’ living with her. These were both flat-out lies.
Facing a Dismissive Judge
All in all, the judge was dismissive towards her and favored them. She left the home with her toddler and newborn; her dog had to go to their dad, the same person they tried pushing out to help!
Trying to Appeal
She attempted to appeal to the court, but they advised her that the decision was final. They said that she was welcome to pursue and pay for legal aid, but she was unable to afford expensive legal costs.
A Difficult Situation
She had no family of her own to rely on and was still very much postpartum. She was also out of work for three months and feeling lost. All the emotions were just stacked up!
Staying with a Friend
She was forced to stay with a friend that she hadn’t seen in a long time, solely to provide somewhere stable for her infant and baby. It wasn’t ideal, but she would have been rendered homeless had she not done so.
Legal Ramifications and Selling the Home
