In the case against Trump for potentially attempting to influence the results of the 2020 elections in Georgia, his lawyers have received a “22-page smackdown” in Kirschner’s words, as the motion was dismissed.
Lack a Basis in Law or in Fact
The motion filed by Trump’s law team seeks to do several things – suppress evidence in the case against Trump for meddling with US elections, have the whole case thrown out or expunged, and also get the judge to remove themselves from the process and throw themselves off the case.
At least they tried
The response from Georgia District Attorney Fani Willis stated that Trump’s “vague and sweeping assertions of due process violations lack a basis in law or in fact.”
It is likely that Judge McBernie will not remove himself from the case, suppress any evidence or throw the case out, although it was probably worth a try in the eyes of the Trump legal team.
Security Concerns Raised Ahead of Decision
Ahead of the announcement on the verdict of this case, Georgia DA Willis has called for “heightened security” presence when the decision is made, sometime between July 11 and September 1.
“Intelligence has indicated the announcement of decisions, in this case, may provoke a significant public reaction,” Willis said in a letter to local sheriff Pat Labat. Atlanta police department confirmed that the letter was received and that they would “continue to monitor the potential for unrest throughout our city.”
Background to the Case in Georgia
The background to this case was the 2020 Presidential Elections in Georgia, where a phone call was made public where Trump seemed to ask state officials to “find” the votes he needed to win the election.
Since then, it seems a whole can of worms has been opened, and the “scope of the case goes well beyond the initial phone call” – Guardian Newspaper2023
It’s going to make for some juicy stuff. Also, if the DA calls for heightened security presence when the announcement is made, that would suggest that the verdict is not going entirely the way Trump would like it to go.
So there may be a small clue about how the case is going from the District Attorney’s point of view – like a teaser trailer for the upcoming case.
Trump Attorney Tim Parlatore Quits the Team
The Trump legal team’s key attorney, Tim Parlatore, recently announced he is leaving the team and essentially firing Trump ironically. However, Tim Parlatore insists that his “departure was a personal choice and does not reflect upon the case.”
Kirschner Video Goes Viral
If you asked people ten years ago whether they thought a YouTube video from a US Attorney would go viral with over 360,000 views in the first day, they would probably laugh off the suggestion as being completely ridiculous.
However, that is precisely what is happening for Attorney Glenn Kirschner as viewers flock to his channel to watch him dressing down Trump’s failed motion to throw out the Grand jury Report into the potential election fraud.
A motion to Quash, a Grand Jury Report, is not really a thing – in criminal law
As Kirschner outlines in the popular video on his YouTube channel, it isn’t even possible to quash a case or have it expunged when it’s a Grand jury Report and that part of the law is not even applicable here. This is partly why he describes the response from the District Attorney as a 22-page smackdown.
Everyone is Interested in Politics Now
One thing that can be said about the post-Trump era of politics is that whether for the right reasons or not, he has certainly drawn many people into having an interest in this area, where perhaps they would not have previously.
Before Trump came into power and the debate was less polarized, it would not be common for huge numbers of younger voters to take an active interest in politics on social media and in conversation. Through all this tomfoolery, we are not only being entertained, but also the layperson is getting to know all kinds of details on legal proceedings and political structures – that is not necessarily bad.
Accidental Education
So while being often amused by all these antics, people are also learning tons of information in complex legal areas, almost by accident. So in a strange way, Trump has actually advanced the overall political education of the planet, as people from all walks of life tune in to find out what bizarre things he has been getting up to recently, accidentally find out US Supreme Court proceedings or how the Grand Jury works.
So at least that’s one thing that has been contributed to society through all this.
